Simone is an AI‑powered chatbot operated by Kantara Limited (“Kantara,” “we,” “our,” or “us”). Simone provides general conversational support and information on parenting and related lifestyle topics through WhatsApp, our website, or other official channels.

Simone is a digital assistant designed for informational and educational purposes only. It does not provide medical, psychological, legal, or financial advice, diagnosis, or treatment. You should always seek professional advice for health or other significant matters.

2. Eligibility and User Responsibilities

2.1 Eligibility

• You must be at least 18 years old to use Simone, or obtain consent from a parent or legal guardian.

2.2 Accuracy

• You agree to provide accurate and truthful information in your interactions with Simone and not impersonate any person or entity.

2.3 Lawful Use

• You agree not to use Simone for unlawful, deceptive, harmful, or fraudulent activity, or to violate any applicable laws or regulations.

2.4 Appropriate Conduct

• You must not send or share content that is illegal, obscene, discriminatory, harassing, offensive, or otherwise inappropriate.

• You must not attempt to interfere with Simone’s operation, security, or integrity.

2.5 Your Responsibility

• You remain responsible for any content you submit and for ensuring you have the necessary rights or permissions to send it (including images).

 

3. Privacy and Data Protection

Your use of Simone is subject to our Privacy Policy, which forms part of these Terms and is compliant with Hong Kong’s Personal Data (Privacy) Ordinance (Cap. 486) (“PDPO”).

 

3.1 Personal Data
Any personal data you provide — including text, images, and optional information — is collected, used, and stored in accordance with the Privacy Policy.

 

3.2 Image Processing and Consent
By sending images to Simone, you consent to their collection and processing for automated, non‑medical informational purposes.
We may request confirmation at onboarding or in‑chat when you first send an image. Once consent is granted, it applies to all further image uploads unless withdrawn.
You may withdraw consent for image processing at any time by contacting us as described in the Privacy Policy.

 

3.3 Data Handling and Retention
We strive to process and delete images as soon as practicable after analysis, and in any event within seven (7) days, subject to technical or legal limitations. While we take all practicable steps, deletion or complete removal cannot be guaranteed in every instance.

 

3.4 Third‑Party Processing
Images and messages may be securely transmitted to trusted third‑party vendors (such as cloud or AI processors) solely for the purposes stated. We take reasonable steps to ensure equivalent data protection under the PDPO but cannot guarantee third‑party compliance in all circumstances.

 

3.5 User Rights
You may request access to, correction of, or deletion of your personal data and withdraw consent to data processing, as described in the Privacy Policy. We will respond within the time limits prescribed by the PDPO.

6. Intellectual Property

All content, software, and materials associated with Simone are owned by Kantara Limited or licensed to us. These include text, AI outputs, designs, code, and branding.
You may not reproduce, modify, distribute, or create derivative works from Simone or its materials without our written consent.
You may use Simone solely for lawful personal use in accordance with these Terms.

7. Changes to the Service

We may modify, suspend, or discontinue any part of Simone without prior notice.
We do not guarantee uninterrupted availability, compatibility, or error‑free operation of Simone.

8. Termination and Suspension

We may restrict, suspend, or terminate your access to Simone at any time if:

• You breach these Terms or applicable laws, or

• Your use threatens the service’s stability, security, or lawful operation.

Termination does not affect any obligations or rights accrued prior to termination.

9. Limitation of Liability

To the maximum extent permitted by law:

1. Simone and its content are provided “as is” and “as available.”

2. We make no warranties regarding accuracy, completeness, or reliability.

3. We are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of Simone, including from reliance on AI outputs or image analysis.

4. You use Simone and transmit data (including images) entirely at your own risk.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Kantara Limited, its officers, and affiliates from all claims, damages, liabilities, or expenses arising out of your misuse of Simone or violation of these Terms.

11. Governing Law and Jurisdiction

These Terms and any related disputes are governed by and interpreted according to the laws of the Hong Kong Special Administrative Region.
You agree to submit to the exclusive jurisdiction of the Hong Kong courts.

Updates take effect upon publication. Continued use of Simone after updates constitutes acceptance of the revised Terms.
